NAGA led an industry effort to reinstate Section 301 tariffs on three graphite products from China that had been excluded since 2020. We commissioned a novel market report by Oxford Economics that presents startling evidence of China’s dominance of the graphite supply chain and demonstrates how tariffs can protect North America’s graphite producers.
In February 2024, the market report was submitted alongside an official letter to the United States Trade Representative arguing for reinstatement of the tariffs. Our efforts were successful: in a major victory for the domestic graphite industry, the tariffs were reinstated on June 15, 2024.
In December 2024, the U.S.-based producers in our coalition initiated an antidumping and countervailing duty (AD/CVD) trade case with the Department of Commerce and the International Trade Commission (ITC), alleging that China is dumping graphite active anode material (AAM) into the U.S. On January 31, 2025, the ITC issued a preliminary finding that China is preventing the establishment of a domestic graphite industry through its artificially cheap graphite exports, triggering a full investigation.
On May 19th, Commerce issued an affirmative preliminary determination in its CVD investigation – which is conducted to determine the extent China is subsidizing the production of AAM – and placed tariffs of 11.5% on AAM from China. Then, on July 17, Commerce issued an affirmative preliminary determination in the AD investigation, asserting that China is selling AAM in the United States at less than fair value, and implemented further tariffs of 93.5%. While the final determinations will not be issued until December 5, 2025, we believe these tariffs are an important first step in helping level the playing field for nascent domestic graphite producers against China.
NAGA has also submitted numerous public comments to federal agencies that have solicited information on graphite and critical minerals, as well as sent letters to leading government officials to advocate for policies to protect and bolster the domestic graphite industry.
